Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Presidential Innovation Award System (the "Platform"), provided by Kenya National Innovation Agency, located at NACOSTI Building, Off Waiyaki Way. By accessing or using the Platform, you agree to comply with these Terms. Please read them carefully before using the Platform.

Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Platform.

Eligibility

  1. The Platform is open only to individuals and teams ("Applicants") who are citizens or residents of the Republic of Kenya.
  2. The startup (“Submission” ) must be legally registered in Kenya.
  3. The startup (“Submission”) must be developing and scaling an innovative product, service, or technology that solves a significant social problem or addresses an unmet need in the market.
  4. The innovative product, service or technology (“Submission”) must be within the sectors of Digital Transformation, Affordable Healthcare, Food Security and Agriculture, Entertainment and Gaming, and Climate Action and Green Energy.
  5. The startup (“Submission”) must have a clear understanding of its market and a viable strategy for customer acquisition and retention.
  6. The startup must have a minimum viable product that has been tested and piloted.
  7. The startup (“Submission”) must have an intellectual property or proprietary technology that differentiates it from competitors and provides a competitive advantage.
  8. The startup (“Submission”) must have an active and permanent team with at least 3 members having relevant complementary skills and expertise.
  9. The startup (“Submission”) must not have received any funding or award fromthe Agency before.
  10. The founding members (“Applicants”) should be youth aged between 18 – 35 with exception to PWDs (between 18-40).

Submission of Innovation and Startup Information

  1. The Platform empowers eligible Applicants to share information about their creative ideas and startup endeavors ("Submissions").
  2. All Submissions must be original and accurate to the best of your knowledge. Plagiarism and misrepresentation are strictly prohibited.
  3. You, as an Applicant, retain full ownership of the innovative content and ideas you submit. By sharing your content on the Presidential Innovation Award System, you grant Kenya National Innovation Agency a non-exclusive, worldwide, royalty-free license to utilize, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and exhibit your Submissions. This license is solely for the purpose of facilitating the innovation exercise and associated promotional efforts to showcase your valuable contributions. Your creativity and originality are at the forefront of this collaboration, and your insights remain at the heart of the process.

Jury Process and Award

  1. Submissions will be evaluated by a panel of judges ("Jury") selected by Kenya National Innovation Agency. The Jury will assess the Submissions based on criteria determined by the Agency.
  2. The Jury's decisions are final and binding. No correspondence will be entered into regarding the decisions of the Jury.
  3. The winners of the innovation exercise will be determined by the Jury and will be awarded prizes as specified by Kenya National Innovation Agency. Prizes are non-transferable and may not be exchanged for cash or any other item.
  4. Kenya National Innovation Agency reserves the right to disqualify any Applicant who violates these Terms or engages in fraudulent or unethical behavior.

Due Diligence and Prize Disbursement

  1. Before the awards are disbursed, winners will be required to comply with due diligence regulations determined by Kenya National Innovation Agency. This may include providing additional documentation, participating in verification processes, and meeting other requirements as deemed necessary by the Agency.

Non-Disclosure Agreement

  1. Both the Jury and the secretariat responsible for overseeing the Presidential Innovation Award System will be required to sign a non-disclosure agreement to safeguard the confidentiality of submitted ideas, innovations, and any proprietary information disclosed during the evaluation process.

Privacy and Data

  1. Kenya National Innovation Agency will collect, use, and protect personal information in accordance with its Privacy Policy, which can be accessed on the Platform.
  2. Applicants are responsible for ensuring that the information they provide is accurate and complete. Kenya National Innovation Agency is not responsible for any inaccuracies in the provided information.

Communication with Successful Applicants

  1. Only successful applicants will be contacted by Kenya National Innovation Agency. Unsuccessful applicants will not receive communication regarding the status of their submission.

Disclaimers and Limitation of Liability

  1. The Platform and its content are provided on an "as is" basis without any warranties of any kind. Kenya National Innovation Agency disclaims all warranties, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  2. To the extent permitted by law, Kenya National Innovation Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the Platform.

Modifications and Termination

  1. Kenya National Innovation Agency reserves the right to modify or terminate the Platform, or these Terms, at any time without notice.
  2. Kenya National Innovation Agency may suspend or terminate your access to the Platform if you violate these Terms or engage in any conduct that Kenya National Innovation Agency considers to be inappropriate or harmful.

Governing Law

  1. These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Kenya.

By using the Platform, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
